Section 39 - Use of personal information
39(1) A public body may use personal information only (a) for the purpose for which the information was collected or compiled or for a use consistent with that purpose, (b) if the individual the information is about has identified the information and consented, in the prescribed manner, to the use, or (c) for a purpose for which that information may be disclosed to that public body under section 40, 42 or section 43. (2) Despite subsection (1), but subject to subsection (3), a post-secondary educational body may use personal information in its alumni records for the purpose of its own fund-raising activities. (3) A post-secondary educational body must, when requested to do so by an individual, discontinue using that individual's personal information under subsection (2). (4) A public body may use personal information only to the extent necessary to enable the public body to carry out its purpose in a reasonable manner. 1994 cF-18.5 s37;1999 c23 s24
